These terms govern website and lead-system work carried out by Red Rock Digital, a sole proprietorship operated by Nathan Fennell in Las Vegas, Nevada. Accepting a quote or paying a deposit means you accept these terms.
1. Scope of work
Every project is quoted against a written description of what is included. Anything not written in that description is not included. If you want something added once work has started, we will quote it separately before doing it. We will never add charges you have not agreed to in writing first.
2. Payment
- Half the project fee is due before work begins. The balance is due when the site goes live.
- Monthly care plans are billed monthly in advance, beginning after launch.
- Invoices are due on receipt. Work may pause on accounts more than 14 days overdue.
- Deposits are non-refundable once work has started, because the time is already spent.
3. What you provide
To hit the quoted timeline we need your content: logo files, photographs, service list, service areas, licence numbers and any specific copy you want used. Timelines begin when we have those. Delays in providing content move the delivery date by the same amount.
You confirm that you own or have permission to use everything you send us, and that it is accurate. We rely on what you give us, particularly licence numbers, certifications and claims about your business.
4. Ownership
You own the finished website. On final payment, all rights in the design, copy and images produced for you transfer to you. Your domain is registered in your name and your business's name, not ours. Your Google Business Profile stays your property, with us added as a manager you can remove at any time.
We keep the right to display the work in our portfolio and to describe the project publicly, unless you ask us in writing not to. Any third-party components used in the build stay under their own licences.
5. Revisions
Each project includes two rounds of revisions to the design before launch. Further rounds, or changes that alter the agreed scope, are quoted separately. Small text and photo changes after launch are covered by a monthly care plan where one is active.
6. Timelines
Quoted timelines, including the seven-day build, assume prompt content and prompt feedback from you. They are a good-faith estimate rather than a guarantee, and they do not include time waiting on you, on a domain registrar or on a third-party service.
7. Monthly care plans
- Month to month. No minimum term and no cancellation fee.
- Cancel by text, email or phone. Service continues to the end of the month already paid for.
- On cancellation your site remains yours. We will help you move it to another host at no charge.
- "Unlimited small edits" means text, photo, price and hours changes. It does not mean new pages, redesigns or new features, which are quoted separately.
8. Third-party services
Projects may rely on services we do not control, including domain registrars, web hosts, form providers, text-messaging providers and Google. Their fees, uptime and terms are their own. We will tell you clearly which ongoing costs you will carry and roughly what they run.
9. Results
We build sites and lead systems that follow current good practice. We do not guarantee a specific number of calls, leads, sales or search rankings, and anyone who does is not being straight with you. Any figures shown on our website, including the missed-call calculator, are illustrations based on numbers you enter, not projections of your results.
10. Liability
Our total liability for any claim arising from a project is limited to the amount you have paid us for that project. We are not liable for indirect or consequential losses, including lost profits or lost business. Nothing in these terms limits liability that cannot be limited under Nevada law.
11. Cancellation
You may cancel a project at any time in writing. You pay for work completed to that point and the deposit is not refunded. We may decline or end a project, refunding anything paid for work not yet done, if the work turns out to be outside what we do or if the working relationship is not viable.
12. Governing law
These terms are governed by the laws of the State of Nevada. Any dispute will be handled in the courts of Clark County, Nevada. We would much rather sort out a problem with a phone call.
13. Changes
We may update these terms. The version in force for your project is the one published when you accepted your quote, and we will send you a copy on request.
